How does a lawyer prove "scienter"? Bankers to blame in the financial crisis?

Very few individual criminal charges have been brought in respect of the financial crisis - scienter (to know that losses were imminent) is very difficult to prove.
Do you think the regulators have done enough?
What about the civil lawsuits to reimburse pension funds etc?
What do you think?
