Do you see it as something the woman would just have to make a claim that it was not a result of consensual sex, maybe sign a statement or something? Or would she have to prove she was raped? It isn't uncommon for rape victims to not want to prosecute because of the added trauma of a trial. But even then, if the rapist is not convicted, would she have to bear his child against her will? What if the trial lasts for 6 or 7 months before the rapist is convicted, can she get the abortion then?
Seriously, in the case of rape, would the woman basically have to be put on trial almost like a defendant before she could end a pregnancy that started by rape, or would abortion be basically legal for anyone who was willing to claim, true or not, that it was not consensual sex?
Realistically, how would it work legally to allow only rape/incest abortions and still be effective at limiting it to actual rape/incest cases without further traumatizing rape and incest victims and making them feel like they are the ones on trial?
