Greetings & Blessings all;
I have a pretty straight forward question (I think)
Both my blushing bride and myself have M.S. - no biggie, there's a lot worse stuff out there - I am "disabled' and Tina is as well but the Soc. Sec. People don't recognize hers because she hasn't worked in the last ten years.
anyway, our COBRA coverage runs out in Dec. - I should get medicare in about 6 mos. but I'm at a loss as to how to proceed to get Tina covered.
Any bright ideas out there? I appreciate any helpful input.
I hope I'm clever enough to get your answers - I'll be trying.

To get Social Security Disability Insurance you have to have worked for 40 quarters(10 years) and at least 20 of those quarters have to be in the last 10 years(work 5 out of the past 10 years). If she hasn't worked, then she doesn't qualify. The only way you might be able to get it would to have a lawyer put together a case showing she was totally disabled during those 10 years and go all the way back until she had those work quarters.

Social Security is for those who have worked and paid into the system. Same with Medicare. Has she worked at all? If so, for how many years? A "worked quarter" is defined as having made at least $900 in the 3 months of the quarter so as long as she made $900 she has 1 quarter. But you need 40 of them to qualify. Has she worked that much?

Social Security isn't for those who haven't worked and neither is Medicare. You can get Medicare without working at age 65 but you have to pay full price. This is one of the reasons Obama is proposing a full overhaul of the healthcare system as too many are falling through the cracks.

About all she can do right now is apply for Welfare and see if there is medical assistance from the state. Medicaid from the state varies state by state as to who qualifies.

we did go to SSA, that's where we got the news she didn't qualify - she has been disabled for more than ten years - when they sent us to the state medical office - we were told that if either of us had three thousand dollars in the bank in any given month @ any given time she would not be eligible for that either.
It does seem to me that her tears of employment before her diability would count for something - maybe the lawyer thing is the way to go?

Yes, see a disability lawyer as she will need to prove that she was totally disabled for the past 10 years but declined to apply. If the lawyer thinks she has a good chance of succeeding then the lawyer will pull everything together and will get a part of the disability as his payment, so you don't have to pay anything up front. It's at least worth a try.
