Your mother's estate cannot be divided until the Will has gone through probate. Once it has, it becomes a public document and can be inspected at the probate office. As executor, your aunt is obliged to distribute your mother's estate according to the terms of her will - if she does nothing within a reasonable time after your grandmother's death, you can go to court to force her to comply with the Will. You are not entitled as of right to see a copy of the Will until it has gone through Probate but your Aunt is obliged to put it through within a reasonable time. You have no said how long it is since your grandmother died, but if it is more than say, six months and your aunt has not done anything about the will, you might think about contacting a lawyer to write to her and tell her to get moving.

...will not send it through probate? How can my mother get a copy of her mother's last will and testament from a lawyer that’s not hired by the survivors to send it through probate? My mother's sister has been named executor and will not give her or her 11 siblings copies or consent to get a copy of their mother’s last will and testament. There are a lot of disputes as to what my grandmother said before she died and what’s in her will. A copy of her last will and testament will help clear everything up for everyone. There are 14 children involved (one is handicapped). The executor (my mother’s sister), her two children, and her husband were all living with her mother (alone with her handicapped sister). Does my mother have to hire a lawyer or can she appeal to the court for that lawyer to grant her copy of the will? Do they all (12 children excluding their handicapped sister) have to take that sister to court in order to make sure that the estate is divided equally like the mother wanted it (since the sister will not reveal a copy of the will)? I just want my mother and her siblings to have peace. Please Help!
