History Q about Hitler and article 48?

it says that once Hitler was appointed Chancellor in Jan 1933, he used article 48 to turn Germany into a dictatorship, but article 48 could only be used by the president.. and that was Hindenburg who died a couple years later. how could Hitler use article 48 if he was only chancellor?
