...to be liable for any injury? Help! how can i set up a free social dirt bike group, so everyone that joins be responsible for own injury?
Hi, my name is brad and I am wanting to set up a free social off road non registeredd motor bike group for families so that even the kids can ride on any type of dirt bike. I have been offered farmers properties to ride on, but I nor the farmers want to be responsible for any liability if anyone was to come off there bike/quad. It is very expensive these days to go to motocross tracks and basically we are wanting to create a place to make friends, camp and have a great time. Can anyone please tell me if there is some kind of Disclaimer or something along them lines that I am able to put in place, so that I can create website and get the ball rolling. Thanks and please help if you can.

Location Adelaide,Australia

Cheers Brad

You need to have everyone sign a waiver...I found a mx park that you can copy the waiver off of...Its at the top of the page when you open it...I think there is 2 pages....so read it all...or print them out....

Did you get legal advice?

As soon as you create a website what you are doing becomes a club. You cannot run a club without things in place to do so.

You also risk having a whole pile of bogans turning up to join on your free group and their behaviour is something you have little or no control over.

A waiver is only any good if you have all safety guards in place to protect yourself and as I said before, if any form of due care has not been shown, for example if a tree happens to get in their way and they can prove that the tree was in a dangerous spot. Or if they come off and the person who helps them is not someone who has a level 2 first aid certificate, or does the wrong thing, then that person and the organiser and property owner is liable. Even if you have people there who have their level 2 first aid it is still a grey area that if they do not react correctly the person giving the first aid can be sued. So them also need insurance to cover themselves.
All this and you are basically opening the door to stranger via a website to join in.
I think you really should get some proper legal advice and be careful.
