Health Insurance company wants money back, Can they take it?

I was in a car accident. I have health insurance and used it to help pay my medical expenses and paid the remaining out of pocket. I sued the drunk driver that ran into the back of me and won the case. Now the insurance company is attempting to place a lien on my court case winnings to reimburse what they spent in my medical expenses. Can they do this?
 
Of course, the insurance company gets the money back that they paid in treatment for you.
You don't get a "double win" - don't have to pay because of insurance and get the extra money from the driver also.
 
Yes, they can certainly do so. Your health insurer paid some or all of your costs relative to the treatment provided. If you were 'reimbursed' for any of such costs by the the driver of the other car, your health insurer is entitled to recover some amounts of which they paid. Understand that insurance is NOT provided to entitle you to any sort of 'profit'. Your health insurer paid based upon your coverages. When it is determined that 'the other driver' has liability for your injuries, your health coverage has ever right to seek repayments.
 
Yes of course they can it is what's known as a subrogated claim. Actually they don't take the money out of your damages, your lawyer should have included their outlay in your claim. If he didn't he has been negligent!
