Have peeping tom ordinances been outrun by technology?

At the heart of this is the right to privacy. I erected a 6' wooden fence completely around my property because I like my privacy.

Apparently, my neighbor also likes MY privacy because he put a surveillance camera on his shed at about the 8' level and is pointed across my swimming pool and directly at my master bedroom. (I have 3 young granddaughters who swim often) Police claim there is nothing they can do because: the camera is not a person (peeping tom) and there are no ordinances that specifically prohibit it even if he WAS watching the three little girls under 10 yrs old.

Police recommended I move to the country. Another police comment: Well, if you're not doing anything wrong, why do you care? I replied: When I take a shower I don't do anything wrong but I have the expectation to a right to privacy.

Has technology outrun the peeping tom ordinances? Are there any ordinances in your area that address surveillance cameras that capture video of areas where you have the expectation to a right to privacy? Certainly, surrounding myself with a solid 6' fence indicates I expect privacy.
