Halo 3 custom games question?

I have a debate with my friend's friend over xbox live. he says you need gold membership to play custom games with people online. I think that's only true for matchmaking.

which is it, do you need gold or does silver work for online custom games(with other people)?
forgot to mention he won't try to prove me wrong by playing custom games
 
I believe you do need to have gold in order to play with anyone online, whether it be customs or not. But, I am not 100% sure, so it'd be best to check it out. I'd get gold, because matchmaking, when playing with people you know on your team, can be very fun.
