Forza motor sport 3 question please answer please please I asked this already 3 times ?

My forza motor sport won't work right when I bought it and I can't return it long story and it froze right when I bought it and I want it to work what can the problem be and if I can fix it how the chinees people tht work in thr game store told me that it probrably got scratched right when j put it in and it does have a slight scrach but that wouldn't mess it up from working and the game goes in but when it is in the advertisement like Microsoft studios etc. It freezes everything even the xbox but I think they just want to jip me for my money
