For court, does the children need to be present? 10 pts best answer!!?

When you having a hearing and court in front of the judge about child custody, does the children have to be there?

We are fighting to get custody of his kids, they live in a different state a long way from where we live. We have summer visitation, the court and hearing may be before they return from the summer visit. The kids will be not be in the state where they currently live. So do we have to bring them back up there for court, or can they just stay in another state while everything happens and the judge renders his verdict?

They are too young to be asked where they wish to live (4,8). Also we get them on Father's day for summer visit.
 
Normally, the children would not be permitted in court. However, if they are old enough to express their feelings about which parent they would prefer to live with, the judge might interview them in chambers about that.

You should ask your attorney whether the kids need to be available for court. It is possible that any such interviews could be conducted before they come out for the summer.
