Financial Issues with X-husband not paying mortgage payment or child support on time.?

Here is my concern... My ex husband just got remarried. He is unemployed and has been for going on 21/2 yrs (Work Comp case pending) However he is getting work comp payments that are more than what I bring home working a 40hr week. He was ordered to pay support based off his work comp income. He pays it late all the time. But my main concern is that our house is up for Sale and he was also ordered to pay the mortgage payment. He has now fallen 3 months behind on the payments. House is going into foreclosure soon. He just seems to think that now he's married and moved out of the house that he doesn't have the money to pay the mortgage. I know he is getting income. And his lifestyle doesn't represent him being in any financial turmoil. His new wife works and has a good paying job. He's moved in with her. Were going to court in a few weeks. Will the judge take into consideration her income or there joint income together when it comes to the mortgage payment being behind and him continuing to pay it until the house sells. Just curious as to how they usually handle situations like this. We even have proof of his income and his expenses and there is no way he can prove he is hurting financially.
