We have an anual event here at the high school where local high school bands come and compete.
The county school system has a contract with a photographer, having rights to do photography on school grounds.
The band wants to get a local photography company (because the company we have now is not qualified for this type of event) to photograph this event. The company we have now has the right according to the contract to say yes or no for the band to get another photography company.
The company we want to get will give us 10% of all profits they make, we don't pay them to come.
If the company we have now says no, the company we want to get will not be able to come.
What i want to know is if I photograph the event, (I am a band parent) can i legally sell the pictures to anyone. I will sell them through a website, but i don't have a business. We will give 90% of the proceeds to the band ("charity" if you want to call it), and we keep 10% for expenses.
So could i legally photograph this event and sell the pictures to people who want to buy them and give 90% of the proceeds to the band. I guess if you have to, you could call it charity for legal reasons.
