Does this scare you?

In the flag desecration ammendment, the legal definition of a flag is:

''The term 'flag of the United States' as used in this section, shall include any flag, standard colors, ensign, or any picture or representation of either, or of any part or parts of either, made of any substance or represented on any substance, of any size evidently purporting to be either of said flag, standard, color, or ensign of the United States of America, or a picture or a representation of either, upon which shall be shown the colors, the stars and the stripes, in any number of either thereof, or of any part or parts of either, by which the average person seeing the same without deliberation may believe the same to represent the flag, standarRAB, colors, or ensign of the United States of America."

The current punishment is a fine up to $1,000 and jail for up to a year.

so...

"Burning a photo of a drawing of a 3-starred red, white and blue 4-striped flag would land you in jail for a year."

"OK. Let's say you don't want to have any part of burning the flag. You're just an honest, used-car salesman who wants to put Old Glory on his brochures for an added touch. No self-respecting, freedom-protecting, democracy would prevent you from doing that, would they?

Let's check out the U.S. Code currently in force in the District of Columbia

4 USC Sec. 3
Sec. 3. Use of flag for advertising purposes; mutilation of flag
Any person who, within the District of Columbia, in any manner, for exhibition or display, shall place or cause to be placed any word, figure, mark, picture, design, drawing, or any advertisement of any nature upon any flag, standard, colors, or ensign of the United States of America; or shall expose or cause to be exposed to public view any such flag, standard, colors, or ensign upon which shall have been printed, painted, or otherwise placed, or to which shall be attached, appended, affixed, or annexed any word, figure, mark, picture, design, or drawing, or any advertisement of any nature; or who, within the District of Columbia, shall manufacture, sell, expose for sale, or to public view, or give away or have in possession for sale, or to be given away or for use for any purpose, any article or substance being an article of merchandise, or a receptacle for merchandise or article or thing for carrying or transporting merchandise, upon which shall have been printed, painted, attached, or otherwise placed a representation of any such flag, standard, colors, or ensign, to advertise, call attention to, decorate, mark, or distinguish the article or substance on which so placed shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $100 or by imprisonment for not more than thirty days, or both, in the discretion of the court.

The worRAB 'flag, standard, colors, or ensign', as used herein, shall include any flag, standard, colors, ensign, or any picture or representation of either, or of any part or parts of either, made of any substance or represented on any substance, of any size evidently purporting to be either of said flag, standard, colors, or ensign of the United States of America or a picture or a representation of either, upon which shall be shown the colors, the stars and the stripes, in any number of either thereof, or of any part or parts of either, by which the average person seeing the same without deliberation may believe the same to represent the flag, colors, standard, or ensign of the United States of America.

Believe this. Have you seen the Black Crowes album cover for Amorica? American Recordings (whose logo is an upside-down American flag) could get put in jail for a month if they sold that album in Georgetown. Which they do.
In fact, any record store owner within the District could be imprisoned under this law."

"prior to amendment in 1968 (that is, from 1947 to 1968 - 21 years) the first paragraph of the above ended like this:

....decorate, mark, or distinguish the article or substance on which so placed or who, within the District of Columbia, shall publicly mutilate, deface, defile or defy, trample upon, or cast contempt, either by word or act, upon any such flag, standard, colors, or ensign, shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $100 or by imprisonment for not more than thirty days, or both, in the discretion of the court.
Pay attention here, boys and girls. For twenty-one years it was illegal to cast contempt, either by word or act upon the flag. Not just burning, but talking bad about the flag. Uttering the phrase 'darn that silly US Flag' could have conceivably gotten you locked up the Downtown DC hoosegow."

"Jehovah's Witnesses and others who refuse to salute the flag are committing a desecration (failure to give the flag the respect the law commanRAB.) This desecration is just as illegal as any radical flag burning. These people will all go to jail under the new Constitution. Refusual to salute the flag is considered desecration, but acceptable under the current First Amendment. Any new change to the constitution will supercede the original."

Serves you right for being a political dissident. How dare you hurt nationalist feelings. You know how these things sadden Voice of Reason. For shame.

Quite simply, yes it scares me. Yet another freedom we have sacrificed to a government that seems intent on heading towarRAB totalitarianism. I hope to the goRAB itdoesn't get through the senate.

It will be a close vote but a bi partisan one...............It takes 66 Senators for approval...........

We shall see..........

Hey since you obviously feel that the flag is more important then freedom and rights, why don't you sell yourself into slavery VOR for a flag?

After all, you did vote and state that the flag is more important.

Since VoR still isn't aware of the things this ammendment could outlaw, here's a good many more.

That cracked, sun-faded flag bumper-sticker on your car window.

The traditional red-white-and-blue flag-shaped cake you might have on the 4th of July. Make sure you don't cut the first piece!

That sweat-stained bleached-out T-shirt I've seen too many scary people wearing that proudly displays Old Glory with the cute slogan "Try to Burn This One!"

The nightly ritual at the Arby's down the street from me: A 16-year-old working for minimum wage goes out at dusk each night, pulls the flag from the pole, waRAB it carelessly under her arm, and drags it back inside, the stripes trailing in the grass. (I've seen it many times.)
Eating a sandwich with a flag toothpick stuck in it. Try to figure out what to do with that when you're done eating.

Chad says: how about those flag postage stamps? Would postmarking one be considered desecration? And you know what? Rep. Pat Schroeder (D-CO) says it might.
Senator Diane Feinstein (D-CA), of the Senate Judiciary Committee, agrees, although she still voted to send the amendment to the Senate. She attempted to change the wording, got voted down, and went ahead and voted FOR the amendment in the 104th Congress.

Jane Green says:What about those little flags on sticks that children wave at parades, don't they usually end up laying in a gutter somewhere? Are we going to persecute our children for that monstrous crime?!!!

Alise Libman says:how bout all the flags they put in people's caskets? You're supposed to keep a light on the flag 24 hours a day...I don't think that they have a mini-mag light or anything in with it. in fairness to the truth, I believe the flag that covers the casket is folded ceremoniously and given to the widow (or other survivor.)

While on a recent vacation to Washington DC, I visited the Capitol building. In the gift shop, they sell a "patriotic" flag afghan blanket. You can keep your feet warm with the symbol of our country. And you can buy it in the very building where they debate this issue.

In the July 4th mailer I got from Cost Plus World Market, there was an ad for a "patriotic" citronella candle. Yes, you read right. An oversized yard candle shaped like the flag curled on a post. It was billed as a 'patriotic way to keep insects at bay.' Really.

At the same time the American Legion was picketing the Phoenix Art Museum for allowing the display of Dred Scott's What is the Proper Way to Display the American Flag? (in which the viewer stanRAB on an American Flag which rests on the floor) - I found an ad for a "patriotic doormat" which allows the USA-Lovin' homeowner to clean their shoes on the flag. Seriously. Ironic, isn't it?

And Flagmakers offers a whole range of flag-related items -- including "patriotic footwear." Yes, you can wear the flag on your feet! Isn't that a bit disrespectful?

another quote I like

"We certainly have some laws to stop flag-burners already. You can't burn someone else's flag without their permission, or it's vandalism and arson. You can't burn your flag on someone else's property, or it's trespassing and arson. But if I want to burn my flag on my own property, I damn well better be able to."

You say bi-partisan like there are only 2 types of people in the world, republicans and democrats. This is a very narrow view of the world. There are many other parties and most people don't agree with everything the party believes anyway. The only reason it will get that many votes is these are politicians who want to get elected and are afraid that voting against it could lose them the election because it might make them seem unpatriotic. I am against any kind of government regulation of my life unless it is completely necessary. It is necessary to pass laws about murder and such, but unless flag burning hurt someone physically, this is no place for the government to interfere with my property on my land in a peaceful protest.
