insurance company to pay for your bi? Does the insurance and the car have to be under one name In order for the insurance company to pay for your bills/damages?

Because i got into a car accident which was not my fault and the insurance wont pay for my bill because of that situation. and if they dont pay can i sue the guy who hit me??? HELP please thanks
