Do you think this is a bad precedent?

Alaina Giordano of Durham, NC was diagnosed with stage 4 breast cancer three and a half years ago now stable and not progressing, is fighting for custody of her children ages 5 and 11. The judge in the case has ruled the children’s father should get primary custody and he now lives in Chicago.
Judge Nancy Gordon ruled that in part because "the course of her disease is unknown" and "children who have a parent with cancer need more contact with the non-ill parent." Giordano does not have a full-time job and cannot support the children, the father should get primary custody. If Giordano wants to be near her children, the judge says she should move to Chicago.
Mind you she had quit her job and moved to Durham years early for her husband’s job.
I find this ironic coming from the same state who embraced Elizabeth Edwards.
 
I would be appealing this judges decision in higher court. I would NOT accept his ruling without a fight.
I think if the father had any compassion he would move near her to make sure the kids see the mother.
The judge is not considering the mothers feelings or the children's.
I say Appeal his decision.
I think the father is doing this so he don't have to pay support to the mother of his children when they are in her custody. Sad
 
I saw Alaina Giordano interviewed on the Today show this morning. This is a bad precedent to set, and it surprises me that a female judge wouldn't be more compassionate and understanding. I agreed with what Alaina Giordano said this morning that this is a dangerous ruling. Though she does have a very bad breast cancer diagnosis and the doctors told her it is incurable, they don't know how long she has to live. And why wouldn't Judge Nancy Gordon want the children to spend the remaining time with their mother?

I wonder if the judge even asked the children what they want? According to Alaina Giordano the children want to stay with her and not go to the father in Chicago. She also said...none of us know how long we have to live...even if someone, like her in this case, is told she doesn't have long to live. Though she said that the doctors and the medical team at Duke in Durham have helped her thrive up to now. I really wish this decision is overturned. And you're right that Elizabeth Edwards was embraced, so why are they being so cruel to Alaina Giordano?
 
I think that Is discrimination, breast cancer is a very treatable cancer and people often live for a very long time after. How cruel to the children. It should not be based on the cancer diagnosis but who would provide the best life for the children,
 
Yeah that's pretty crappy, especially if she has custody currently. Usually my state tries its best to side with the mom and if she loses primary custody, dad should be made to move back down here since she ended up here because of him in the first place. She needs a better lawyer because she shouldn't be made to leave nor lose her kids, as she's near three of the best hospitals in the country.
