Do you think it should be illegal to ride your bike at night?

Here in New Mexico, its not illegal. the other day i was driving and i almost hit some guy on a bike!! i could barely see his lights and when i did i was too close and almost hit him!! he was wearing really dark clothes too! it was scary! wat do you think??
