I have a strong case against my lawyer, but he has drained me of every dollar the case has dragged out and when it finally came time to go to trial my lawyer didn't get the evidence in on time and the judge wouldn't even let us talk about it, he didn't add my expert witness on a mold case and then the judge ruled we couldn't talk about mold. the board president of the association told another condo ownere that my lawyer is in their pocket and that he works with the law firm that represents me and that he will do what it takes....
Even with trial on the following morning this lawyer didn't even call us back, keep us updated.
As we started to fall behind in payments, he started to care less.. isn't that also a breach of fudiciary duty, isn't he supposed to put my case and do the best he can anyway or quit?
I can always file with the ethics board, but that doesn't put his legal fees back into my pocket or pay me back for the damages he has caused by not handling the case correctly.

I see that a lot of lawyers work on a contigency fee basis for malpractice, does anyone know if that includes legal malpractice?
And has anyone actually won a case of legal malpractice in the state of NJ?
