Do I REALLY need to upgrade my plan on Sprint for any Android phone?

I'm wanting to switch from my HTC Touch Pro to an Android phone. I already have unlimited data, and texting along with shared minutes and such on my family plan.

However, if I upgrade this phone -- Sprint is saying I need to switch to a Data Family plan, even though I would be the only one USING the data, and texting -- which I already have. Plus a $10 premium data fee (which I can understand).

Is there any work-around with this? I don't need a 4G phone (we don't even have 4G here!) by any means, and I don't plan to do mobile hot-spots.
