Determination hearing scheduled 9-12-07

I finally got a call telling me I have a hearing scheduled for tomorrow. I went to the lawyers to get "prepped" for it and i guess Im ready. Something he said though that concerns me - the judge can rule 1 of 3 ways. 1. He can deny the claim, 2. He can approve the claim and I get paid from the time of the claim, or 3. He approves it, and as of 50 years old (turned 50 Aug 16th) start my benefits. I've never heard of the last ruling - ever! I guess its some new sceme they've concocted to screw you out of the money you paid in all the time you worked. Its been a long time, and there are so many bills to pay that has piled up over the past 2-2 1/2 years, I'd really appreciate your prayers for a favorable outcome. Thanks so much. I'll fill you in on the details when I get back from the hearing. :angel:
 
I've never heard of the third option either. I was 53 when the judge heard my case. Mine went back to the start with a 6 month wait added to it. Good luck. Fred
 
Had the hearing, the judge said he'd rule within 60 days - jeez, what other delays can they come up with........ my lawyer says he thinks all went well but he had almost no input after the judge started asking me the questions. He said that was a pretty good sign - as in he'll be putting alot of weight on the statement from my doctor that I am unable to work, and cant lift over 10lbs. for any given amount of repetitions. I guess its just a waiting game at this point, but I hear alot of people hear back in like a week or two....
 
Yes, its for disability, and my MD stated in his report (for the record) that its his opinion that I cannot work any longer due to my back problems.
 
Finally received my decision right at about 30 days later and was found to be disabled by the Judge. I got a wonderful christmas present (Dec 26th) of my back pay for approx. 2 years, minus the attorneys fees of about $3500. The downside to it all - the wifey & I went to get our taxes filed and the statement shows part of the back pay is for 2006, and part for 2007 and have to pay on it. To top it all - I now have to have 15% taken out each month for taxes because of our corabined income. Oh well, better to have, than have not I guess :)
 
Is this for disability? Does your MD tell you when you've reached this point in your back problems? Best of luck to you, hope you hear soon.
 
Congrats on getting your hearing scheduled. You are in the home stretch now. Hope everything goes your way. Oh and I have never haeard of that 3rd option either. I remeraber in my hearing they had 3 experts there and when the neurologist testified, my lawyer nudged me and said " We just won" I was happy but took the wait until I see it in writing approach. I ended up getting 13,000 minus attorneys fees. So good luck and let us know how it goes.
