In class we're doing a debate on habeas corpus. My team is debating that terrorists should have the right to habeas corpus. So far my points include:
Guantanamo Bay
the Canadian Charter of Rights
and a speech from President Obama

what other points could i use to argue that terrorists should have the right to habeas corpus? and any examples for a closing statement? i need some guidance.

thanks everyone :)

Terrorists are not mentioned in the US Constitution. How can a label be used to strip a person of their inalienable rights? Who decides who's a terrorist? Obama, the winner of the Nobel Peace Prize, is ordering his military and mercenaries to kill thousands of people in foreign countries that have been shown to pose no threat to us, that have not invaded our lands, nor declared war on the US ... is he a terrorist?

I gave all three of the first 3 answers a thumbs up; all good points.

I would like you to add the reason they were held there; as being out of our country ALLOWED our government to evade the bill of rights.

Neither the 5th or the 6th amendments mention " citizen";
Amendment 5 "No person shall be held..."
6th "...the accused shall enjoy the right to a speedy trail..."

Argue we are a country of laws. Argue we preach democracy to every country and how great it is and that habeas corpus is part of democracy.

The Sixth Ammendment of the U.S. Constitution

"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial."

Be sure to emphasize on the word "all".
