His name doesn't HAVE to be on the birth certificate. If he can prove through DNA that he is the biological father he has every right to visitation. It doesn't matter who the child calls daddy, he still has the right to see his child, and he has the right to take you to court.

hi all, i have a 3 year old daughter. Her biological dad left me when i was pregnant, decided to wlak into our lifes when she was born, then walk out, he then went to prison for drug related offences got out of prison, walked back into our lifes when my daughter was 2 and never stuck around. Now a year later he wants to walk back in.
My daughter now calls me ex dad, as he has been the father figure in her life from birth (non biological dad). she sees him on a regulair basis.
I recentley seen my daughters biological dad and tried sorting this mess out, we agreed on her seeing her on a tuesday for a few hours after school. We agreed this at the beginning of the week,
He then missed the first tuesday and gave excuses, and he now phones to say he cant make the following tuesday, basically hes screwing me around.
I then said well see our solicitors and draw up some papers for both of us to stick to, but know he is going to take me to court?? (his name isnt on the birth certificate)
Anybody got any advice for me ? thanx
