does anyone know if i can upgrade on another line in my family plan and use the phone on my sim card? i dont wanna spend 300 to upgrade but with my brothers number its 179. Also, the 2 year contract is only the phone services right? Meaning I could cancel the data plan when i receive the phone and add a data plan to my phone, thanks.

You could upgrade another phone on your family plan to receive the discount for the phone and then use that phone with your sim. That will work, no doubt. That is what I did when I got my G1. However, Tmobile is now requiring the data plan on the line with the G1 (or the line it was sold under for the discount) so unless you get lucky and they miss adding the data plan you will have to pay the extra. Or you could upgrade your phone and once received switch to the unlimited everything family plan, I did that and the price ended up being $20 cheaper for me.

To answer the OP, yes this would work.

Even if they require a data plan for the line that the device was sold on, you should be able to cancel it or just pay for it for a month and then cancel. I do not think that this would void your subsidized price.

You can definitely cancel the data plan anytime after you get the phone. I purchased a G1, had the data plan for a week then cancelled it. When I wiped and needed the data plan to activate the phone back on, I just added the data plan again from the t-mobile website, an hour later it was on. Then the next day I cancelled the data plan again.

The bill reflects a pro-rated charge of the data plan for 1 day. I've done this several times without any penalties from T-mobile at all, and I still got the G1 at the subsidized price.
