I was having a debate between me and a friend of mine, the debate was rather an individual would be convicted with burglary, home invasion, or both.
Here's the scenario.
A 25 year old male was at a party and decided to take PCP, as the night progressed he walks out of the party (high on PCP) into the street and approaches a house, and breaks in but doesn't steal anything. The owner calls 911 and later makes the arrest.
Okay does this 25 year old male get charged with Burglary and home invasion? My friend says no, because he only intended to take the drug, but didn't intend to break in the house. But I say it doesn't matter if he's high on PCP, he will still be charged with Burglary and Home Invasion (and of course for the PCP). What do you guys think?
