Could I file a lawsuit against Chevrolet if most of my injuries were there fault?

my boyfriend was a passenger in a chevrolet 2005 trailblazer,where as the driver hit a cement wall on the highway an my boyfriend was sitting behind the passenger and when the driver side struck the cement wall his door flew off and he got throne out of the truck and slided acrossed the highway. He was not wearing a seatbelt, but yet he is over the age of 18.He has two fractured disks in his back and is still swollen on where he got stitches. The car accident happend 8months ago.
 
Well I don't think you have a case any Lawyer will say that he did not have a seat belt on even if your of age and sitting in the back it is law that you wear your seat belt. to prevent getting ejected when in an accident. Sorry.
