Quite a silly reason that leads me to ask, but after seeing half of "Letters of Iwo Jima" and that passage where the HQ refuses to send reinforcements to aid in a desperate situation, i thought about the prospect of surrendering to the american forces. Could the officer giving such an order (or his men) be presented in front of the martial court AFTER he is freed as a prisoner of war (in 1946 for example)?
Also, When can a soldier legally surrender in military law ?
