I'm looking to sell some books on my website and would like to take a photo of the cover of each book to display on my website.

The question I have is that in the inside cover of each book, its states that no part of the book may be replicated by any means.

If I am marketing and selling the book am I infringing copyright?

Where do I stand legally?

Should I seek agreement from the author?

Should not be a problem or otherwise all those second-hand book stalls would be spending all their time getting permission to show the books on the stall. Have a look on Ebay and see what the other folk are doing on the books section. I have yet to find a book without the proviso on the inside cover but this usually refers to you quoting a passage from the book especially trying to pass it off as your own idea.

I don't think so but you could check the US COPYRIGHT OFFICE to make sure.

At least to me, you are selling their complete work. It is not like you are stealing the cover art to put on your project. You are just reselling what you already paid the author for. Just my opinion. Don't take my word for it. I would still check with the Copyright Office.
