I had a written agreement with my child’s mother to pay her a set amount per month – this was notarized. After 1 month we realized the amount to paid was too high and decided to cut it in half. She accepted this and had no problems until 9 years later after receiving/accepting and cashing all these payments she is saying I owe her back child support. I understand I should have put the new agreement in writing but I heard that because she accepted payment and cashed the checks that this her acceptance of the new agreement. Especially considering she’s been accepting and cashing these checks for over 9 years now. Where do I stand legally?
