Im originally from Michigan, and upon moving to Colorado, purchased a truck from a lady. We set up a payment plan. Since we didnt have emissions testing in Michigan, I didnt know that CO law requires the seller to provide a passing emissions certificate. It failed its first test, so I tweaked it a little, and it failed again. I spoke with a mechanic, and upgraded some parts. Once again, it failed.
So... after learning that it was her responsibility to make sure the truck passed, I asked her if she would pay for the necessary repairs. She said emissions was my problem now.
Bottom line- I stopped making the payments because my temp tag expired and I can no longer drive the truck legally. She keeps harassing me for the money, which I wont pay her until the truck passes emissions. What are my options at this point?
Also: the obvious option is to give the truck back and get the money back from her that I've already payed. But... she says she doesnt have the money, and cant give it to me until she re-sells the truck. I really dont want to give her the truck back, and hope she gives me my money eventually. Not to mention, it would leave me without a vehicle or money to buy a new one.
