Christmas Mischief: Replaced iPod (4th gen to 1st gen) - PLEASE HELP.?

So my mom bought me a new 32 GB 4th gen iTouch from target, and when I opened the box I was expecting just that, but instead I ended up getting a used 8 GB 1st gen iTouch. Basically someone bought a new 32 GB 4th gen iTouch, opened it up carefully, and then replaced the iPod with their old used one. I turned it on after noticing 8 GB engraved on the back, and looked for any way i could track the person down. All I got was a wiped iPod with 1 note saying "Danielle" made 31 days ago on November 24th. Honestly I think it's just something to lead us off the track of the person. My mom has the receipt and of course, the date of it is after when the note was made and on it it says she bought a 32 GB 4th Gen iTouch. Is there any way to catch the person and/or get my REAL present without spending more money
