Okay, I live in Texas, my son lives in Georgia. His mother and I share physical and legal custody but he is supposed to primarily reside with me. Immediately following the divorce I allowed my son to go with his mother upon his request. He stayed with her for a few months, then came with me for a few months. This past year I was deployed until late July. Since I was gone for the time, he stayed with her and her parents. Now, I have came back and have requested for him to live with me but she refuses it. Our divorce decree is very vague on certain times and dates for visits. Although he is to primarily reside with me, I had to allow her to keep him while I deployed. So, now I want to get papers drawn up to make specific visits for her and to enforce the fact that he is to primarily reside with me. SO... to get to my question, I need to know where I need to file and get an attorney at. Do I need to go to Georgia and get a lawyer there since my son has been living in that state, or do I get one here? m If I get one here will the lawyer most likely have to travel for court to Georgia out of my pocket?? Please any information would be helpful..... Thank you!!
The initial proceeding took place in New Mexico. I not only want my son to come live with me, I want the court order to be more clear about specific dates he is with her. I dont want to bring him over, only to let him go with her for a holiday and then she says he's staying now. I want to get everything specific so that later there are no questions or any fuss.
