Charles Barkley versus Vegas DA...?

Running through the rough facts of the Charles Barkley gambling situation: He gambles in Vegas, loses, gets four independent markers totaling 400k. He doesn't pay them back promptly. They contact him, he still does not pay (he says they didn't contact him). The DA threatens prosecution if the money is not paid back. He pays the 400k. The hotel says the debt has been paid in full. The DA still threatens prosecution because of 40k owed to the DA.

Ethical?

While answering the first question, I pose another: Isn't this really the public prosecutor performing legal services for a Vegas casino? Is this not simply a contract claim and breach thereof?
