cellphone tmobile sidekick 2008 its like defective and broken?

my sidekick 2008 is like defective randomyl it deltes my contacts and sometimes doesnt charge. & doesnt ring when i get a txt even when i set it.

i got the phone in august of 2008 can i trade the phone in or something? for like the new sidekick 09 or what?
