Car insurance is sending me check payable to me.?

So a car insurance company is sending a check payable to me to fix my car. It was a fender bender so the damage is not that extensive. I would like to keep the money and not fix the car. Does anyone have any experience with this? United states New York state.
 
You can keep the money if you want. It is legal. The insurance company meet their requirements to pay you. They do not care what you do with the money.
 
You can keep the money, but the insurance company will note that you have existing damage on your vehicle. If you should get into another accident, and there is new damage in that same area, they have the right to deny your claim until you prove that it was fixed.
If you do have a loan on the car, most contracts require that you keep the car in good repair. That would include fixing the damage.
