my son narrowly avoided an accident when a driver braked very suddenly they missed a junction, although he swerved to avoid hitting the car he hit a barrier at the edge of the road. a truck behind him then hit him and the insurance company says its my sons fault and are going to repair the truck under his insurance. In my opinion the truck should have been travelling at a safe distance to stop. I know my son did not stop safely either but now i have the opinion he should have just hit the first car and claimed the same way the truck is !!
has any body got experience with this and do you think i should fight the claim? his insurance is already £1800, i don't want to see it go up!
