car dealership bad or ?

This is my question I have a car that i wanted to trade but the problem is that the car is not mine I took over car payments and we had the car for 2 years now and just wanted to get out of it know i have bad credit also. So i went to the dealer and they told me that the owner has to be there to sign off the car and once he does it then they can trade it for us or just put the car in my name and we buy the car off the dealer so i was not thinking i had the owner come and sign the papers. My question is can the dealer now own the car cause the owner signed off the car to the dealer if our credit does not get approved for my own car. The car is at my house right now i need some answers please help!!
