Just hypothetically speaking -- I'm writing a philosophy paper and this came up. A person who obviously hasn't bathed in MONTHS and just smells intolerable sits next to you on a subway or bus. Let's say it's even making you retch, gag, etc., can even make a person faint. Obviously they are insisting that an entire crowd of people sit around and endure their stench. Can they get arrested? Under what charges?
Oh and they're not smelling like drugs, blood, or anything otherwise incriminating.
