Can voter apathy be legally counted as a "yes" or "no" vote in a ballot?

This is to do with a low turn out of 37% in a ballot regarding an unfavourable change of employment contract and subsequent working conditions. The originators of the contract are seeking to claim that the 63% that did not participate in the ballot can be legally viewed as voting "yes" to the proposed changes. Would this be lawful?
