Can the judge do this?

If I don't wanna file for full custody even though according to a lawyer I have a chance, because I want peacefully 50/50, but my ex files for full custody.

Now to fight back I can ask the court for full or shared custody.

If I choose to go for full custody just like she did, can the judge say "NONE OF YOU GET IT, YOU BOTH GET 50/50", or do you have to ask for shared custody in order to get it?
 
i'm pretty sure you have to ask for a shared custody, but to make sure confirm it with your lawyer that you want 50/50. Becasue if you gett full custody they won't let her near them, there will be like a restraint of some sort.
 
Depending on what state your in the judge can and most of the time will grant shared custody to the parties. Unless one of the parents have some serious issues such as drug or alcohol abuse or an unstable and safe lifestyle both parties should share custody. If the parties can agree on all the issues pertaining to your case they can sign stipulations to what they agree to. This saves a lot of time and money for everybody. And you both can customize your access and visitation plan any way that would fit both of your work schedules. Good Luck!!!
