Can someone use my Michigan registered business name?

Long story short: I am registering a business name using a DBA. Someone else is using the same business name, but it's not registered with the county. It's an established business of probably 2-3 years. However, like I said, it doesn't hold a DBA.

Would I be able to register the business name and send a cease and desist letter to stop using the business name?

I would prefer answers from people familiar with business law in Michigan or people with business experience in Michigan.
