Can someone clear up an argument about the state of Texas and its state treaty of 1845?

I have heard that according to the treaty the Republic of Texas and the USA signed in 45 that if they wanted to, Texas could legally succeed from the US.

However i have also heard that the truth is that it can split into 5 states if it wanted to, but not succeed.

Does anyone know what the true answer is?
