my finace already filed his taxes and were waiting on getting them back and in his previous marriage the divorce decree states that he claims his son on taxes (we live out of state too) and she can claim head of household. Shes now stating that her attorney contacted her to let her know she was granted a motion to claim her son. My fiancee has already filed, claiming his son like the divorce decree states. We also havent recieved anything in the mail regarding this matter. Is she able to do this? my fiancee pays $600 a month for one child. how is this going to effect his taxes since he already filed claiming his son and shes already filed claiming their son as well. from what we know shes blowing smoke about the motion. I dot see how the courts could give her this motion without notifying the father of the child of this change. Is it possible?
