...repairing the car? Can parking company clamp me for not having car tax in my communal parking while repairing the car?

seems they clamped it on the 14th day since expiry of disc
OMWTD- there was a note and couldn't have thought it was dumped
OKA- they have a head office with no head- tried to speak to them
203- they dont work with DVLA

if i did not pay release fee they were going to take it away..so bought tax disc 6month and release fee £200
 
It depends on the terms of your lease, or whatever other contract you have that allows you use of the parking space.

When I lived in a building with communal parking, there was a rule that all cars had to be taxed and insured, and that commercial vehicles were not allowed.
 
I suggest you chase this up, as far as I am aware the law only requires you to have a tx disc if you are parked/on the public highway. If you are on private land then a tax disc is not a legal requirement.

I would say though make sure you register the car SORN or off the road with the DVLA, you can do this via the website. If you don't register it as off the road you will most likely be issued with an automatic fine from the DVLA computer system.

But if you are parked on private land then not having a tax disc is not a legal reason to clamp the car.
 
Yes they can. It is still on the public highway, and therefore ilegally on the road if it doesn't have tax.
 
A car must either be taxed or have a SORN (statutory off road notice) there are no inbetweens anymore.

Was it a private clamping company or the DVLA themselves who clamped it. The DVLA now drive around in vans with details of cars with expired tax ready to clamp them.
 
I believe they can fine and clamp you if they have notices to that effect. £200 is a riip off but they'll say you should have known.
I know what I'd do though: go and find the worse possible car you can at the local car auction, buy it in a false name, heavily strip it and dump it in the carpark. Then when the clampers take it they won't find who owns it and won't get much for it when they have to scrap it.
 
No. a car can be legally untaxed off the road.

Agree that they may think it has been dumped, ring them up and have a polite word with them

It won't be the DVLA, they do not clamp cars, it will be the company in charge of the private parking yard.
 
It seems rather like they have done. Clamping companies don't observe any laws. Send their head office an invoice for £500 for loss of use of the car and tell them that you will be seeking a further £100 a day until the clamp is removed.
 
If there is no tax on the car they may have thought it was dumped. You need to speak to them or even citizens advise x

If your communal parking is private land they cannot clamp you . also as you did have 14 days from expiry of your road fund licence to inform DVLA of any sorn you were going to do . you have been clamped illegally

For 5 pounds you can issue the clamping company with a notice of intention of taking them to court . also they are regulated by the local authority . make a complaint to them also .

Do be persistent in this and you will get your money back
 
If your car is or was parked on private land ie off the public highway
and not owned by private Company/councils ect then clampers have
no right to interfere with your vehicle they are working illegally
 
If your communal parking area is of off the road there is no way they can clamp you for no road tax. If you have no road tax because it is of off the road you should have sent in your SORN notification. If your parking area is part of the highway then they probably have the powers to clamp you. Many people are employed now to take numbers of cars without road fund on them, such as Tesco attendants, NCP etc.

remove it and get away with it

its easy unbolt your front suspension lower arm and take the wheel off and replace it with a spare wheel ..its as simple as that

dont damage there clamp or chain though
just get a mate to drop there property off at there company
 
Get a life man cut the fuc*ing clamp off and tell them to shove their bill where the sun dont shine
