Can I sue this restaurant? What would you do?

Awhile ago I went to a local Mexican food restaurant and ordered a vegetarian burrito. I came home and was eating it halfway through when I found this disgusting thing in it. It was a tooth-like animal bone that was hard as a rock. I nearly choked and hurt my tooth on it. I called the manager and told him about it, and he said he could give my family and I all the food we wanted for free for compensation...We told him we could sue him for this, and that's when he said that.

If this was you, what would you do? Stupid restaurant!!
They use their bare hands when they make the food too! Maybe get a health inspector to check the place out? People shouldn't eat at a disgusting place like that.
 
take the free food it will take lots less of time and money than suing them would and you have a big chance of losing
 
The problem id you ate at home. Legally you got nothing, take the free food cuz you don't have a case strong enough to sue for a refund. No lawyer would take the case unless you had two reliable witnesses that would swear that they had a constant visual on you from the time you got the bag to when you found the object. because the defense will say that you placed the object with intent to sue, you had ample time and opportunity to do so.

being they offered compensation they dont want to loose your Business
besides to win you have to prove that you found it in there food
 
Yeah my family owns a few restaurants (none mexican lol) and you really cant sue them for that. I mean you could but it wont really get you anything believe me...people will try but the people in the restaurant business are stubborn not to mention connected. Just take some free food and be really nice to them and live as a decent human being who accepts a mistake.
