Can I start an online business while living overseas?

The whole point of an online business is that you can operate it from anywhere in the world.

I know an American who lives in Brazil and runs an online business that services clients across North America and Japan.
 
I live overseas but would like to start a website to sell digital content that I produce. As an alternative, I could sell physical units. For example, language CDs or travel guides.

I'd like to know if it's legal before I look into marketing. I am currently exempt from Federal and State taxes as a result of my location. I am from NJ, USA.

I'd like to form an LLC, or S Corp. Which is more suitable? I'd eventually file for DBA and Seller's Permit.
