Can I send my deffective blackberry back and get a new one?

no you cannot because this would count as an unlocked phone

since you werent the one to buy it from them they wont accept it

even if your brother had a warrenty it voided the second you took it because its not the same user anymore. plus its been 2 years so its probably out of warrenty anyways

if the phone was brand new then you could have sent it back
 
My brother bought it, maybe 2 years ago from ATT. He gave it to me a year after using it, and since it has been working well until this week. It randomly makes the screen clear and a little hour glass appears, it will do this within 30 seconds every time I use the phone.

I looked up how to fix it. Theres NO way to fix it but send it in and get a new one. Can I still do this even if it is not my phone when it was purchased? It is ATT by btw.
