I was stopped for expired registration but then asked if I was drinking. I told officer I had a couple beers just before leaving the bar. I was immediately given a breathalyzer and blew 0.07% and then was given field sobriety tests on a sloped road near a lot of power lines... i did marginally well and was told to repeat the breathalyzer and blew a 0.09%. I was arrested. I requested a blood test be done because they told me that I would have my license taken on the spot if I didn't. I spent 3 days in jail before seeing a judge. I was released until the test came back. This is my 1st offense. I did not have the money to hire an attorney so I went in and talked w/ DA and he told me that my blood test came back with a 0.11% and to plead "guilty" and he would give me a chance to lower the charge to "reckless driving" if I completed the driving test online and a victim impact class plus a fine of $837. I agreed. But later could not afford to pay fine or pay for the classes. I called the court and told them. They extended it for 1 month. But still I could not afford it all. I never called back and thus a bench warrant has been issued. Since my BAC was rising, can I now go back to court and change my plea?
