can i get a blackberry with a 40 dollar monthly plan?

i really want a blackberry but i have some things from stopping me.
- do you have to to have a data plan if u have the unlimited student plan from rogers?
- i have a three year term with another phone and don't know if i can get another phone. (but i think i can cancel it for a 200 dollar fee)
