for the military? i put in notice because i leave for basic training in 4 weeks. my employer terminated me after 4 months of employment. they gave me a rediculous, almost unbelieveable excuse, based on hear-say about why i was being terminated. can i fight it? what are michigan laws on this? i am most definately going to at least fight for the un-paid breaks that i was required to log, but never took (with proof that i never took them, because i was the only one in the store at the time, no one to cover me, therefore i was required to work throught my 30 min break that was logged... Videos proving this). im not sure exactly how to get them, but i know something is fishy. i called corporate, they emailed the owner and she was supposed to contact me... but she never returned my call.

thanks in advace for all your help!! n
the rediculous excuse they gave me was the someone went on our on lone customer service survey and said that "(my whole name) told the customer in front of them in line, that one of our products was 'nasty'" my name tag says my nick name. so this is why it is so fishy to me. not to mention i've only been written up once during my employment here. it was because my cash drawer was short(the first time ever). when i was telling my Asst. Manager that i didnt want to sign the write up, because the Manager *conviently* forgot to leave me drop slips, to make sure my drawer was correct, she told me to make sure i count my drawer before every shift because the manager borrows money from the cash till sometimes.

i duno if that helps any

Unless a contract of employment exists or an employee is a member of a union, an employee's term of employment is usually considered to be "at will." Generally, at-will employees may be fired without just cause. In fact, the termination of an at-will employee's job does not have to be supported by a good reason or by any reason at all. At-will employees are also free to resign their positions at any time.

Since you didn't mention the "rediculous, almost unbelieveable excuse, based on hear-say" reason they fired you for, I can't comment on that.

You can contact the Wage and Hour Division and report them for failure to pay for the break that you didn't take, but I seriously doubt that they will force the employer to supply the tapes that you say are evidence, not to mention that by th time the complaint rolls around to being investifated, the tapes will most likely have been recorded over.

Definitely file for the breaks you were required to work through. I once received a nice hefty check from an employer who required me to do the same.
