I have a small claims case I put against my former roommate who defaulted in rent and was forced to move out to avoid eviction on our lease agreement for the house we rented.
She is counter claiming she does not owe me any money, of course. I'm not surprised she would respond that way. Any way, I have all the documentation to prove the matter. I even have a separate formal contract I had us both sign explaining rent is paid by half and utilities cost is paid by half which also includes a break down of costs attached to the lease agreement. but recently I have found a couple of previous emails from the defendant to me explaining she will not have rent for July 2009. Then a couple of more with her stating she will have the money on July 17 2009. Then later proceeded to not have the money after all. Can I use those emails to prove she acknolwedged she did owe money as well?
